TERMS & CONDITIONS

These Booking Conditions constitute the entire agreement between the parties as to their subject matter and supercede all prior agreements and understandings between the parties. By making a booking and paying your deposit you accept the following booking Terms and Conditions.

Validity of Information - The information presented was correct to the best of our knowledge at the time of printing but is subject to change without notice. Please confirm details of your requirements at the time of booking to ascertain if there have been alterations to the tour you select before you book.

Passenger Details - We require the correct full names of all people travelling in order to make bookings as well as a copy of their passport to avoid errors with names. Should the wrong information be given, The Travel & Cruise Company reserves the right to charge additional fees to cover administrative costs and/or fees charged by suppliers to effect such a correction.

Deposit & Balance - - A deposit will be required upon reservation. These deposits vary according to supplier requirements and these will be advised at the time of reservation.

Payment of deposit represents acceptance of The Travel & Cruise Company’s, and the relevant suppliers, Terms & Conditions by the purchaser and/or passenger/s. The balance of the tour is payable 60 to 90 days prior to departure unless advised otherwise at time of booking. For reservations made less than 60 days before departure, full payment is required immediately upon confirmation.

Payments can be made by bank transfer or credit card. A Credit card handling fee of 1.5% will be collected on Master and Visa Cards whilst American Express cards fee is 2.5%. Bank transfer payments can be made to:

Prices & Minimum Numbers - Pricing can change due to various factors including, but not limited to, changing airfares, exchange rates fluctuation and spot specials. As these factors are beyond our control, we reserve the right to change our prices without notice. It may also be necessary to change the tour components, the departure date, or any other aspect of the tour at our discretion until the tour has been paid for in full. Tours are generally based on a minimum number of participants and if this minimum number is not reached suppliers reserve the right to cancel or re-cost tours as appropriate. Should this situation occur and you decide to withdraw or if the tours is cancelled by another supplier, your deposit will be refunded. In all other situations the deposit is non-refundable.

Changes In Itinerary - As we are only an agent for airlines, hotels, tour operators and other Service Providers (see below under “Responsibility”) your booking may be required to be changed or cancelled due to circumstances outside our control; for example, if a hotel is overbooked or an airline changes its timetable or reschedules its flights or if a tour is cancelled. Further, at certain times of the year, due to heavy bookings, we may not be able to acquire the accommodation advertised. In this case, we will use alternative accommodation of a similar standard, or the next best available. Accordingly we reserve the right to vary your itinerary or cancel your booking at any time.

Cancellation Fees and Refunds - Any cancellations must be received in writing and will take effect from the date it is received by The Travel & Cruise Company. Cancellation charges vary according to supplier but you will be advised of these costs before any action is taken to cancel a tour or service.

Travel Insurance - It is recommended that adequate insurance is arranged at the time of paying a deposit. We recommend a comprehensive travel insurance to cover cancellation, health requirements, luggage and additional expenses, in particular to cover emergency evacuation. Should you not take out insurance, we cannot be held responsible for costs incurred including cancellation fees.

Passport & Visa Requirements – Passports need to be valid for at least 6 months beyond your return date to Australia plus your passport should have at least six blank pages. It is your responsibility to obtain necessary visas, re-entry permits, etc.

Privacy and Data Collection - To process your booking, we required to obtain your personal information the details of which we may be required to release to third parties such as:

  • Service providers
  • Customs
  • Immigration authorities
  • Security and credit checking organisations

In some instances, we may be required to release your personal information to authorities outside of Australia that may not have the same level of protection as Australia. Personal information may include:

  • Name
  • Date of birth
  • Address
  • Passport details
  • Visa details
  • Medical conditions
  • Phone and/or email
  • Emergency contact details

By making this booking, you consent for The Travel & Cruise Company to hold and release your personal information to third parties. You also consent to our using your personal details for our own marketing purposes. Your details will not be disclosed to a third party other than mentioned above.

Consumer Claims - While we endeavour to have all your arrangements run smoothly, occasionally problems can occur while you are away, in which case it is essential and most practical to try to resolve it locally with the provider of the service. If you are unhappy with your hotel room please inform the duty manager so the situation may be rectified on the spot. If you fail to take these steps a claim to compensation, if any, may be reduced or denied. If you have an unresolved complaint this should be put to us in writing detailing the efforts that were made with the local operator to resolve the issue. Please send this with supporting documentation within 30 days of the date of the service. No claim made after this period will be considered.

Responsibilities – The Travel & Cruise Company (a division of Sisu Corpration Pty Ltd ABN 74 146 187 779) do not themselves provide carriage services, accommodation, transport or tours. The Travel & Cruise Company act as agents for accommodation providers, air, coach, shipping, rail and other carriage or transport providers, tour operators and other service and product providers (referred to as ‘Service Providers’). All products and services provided by Service Providers are provided on those Service Providers’ own terms and conditions, which may include limitations and exclusions of liability. All bookings with The Travel & Cruise Company and all tickets, vouchers, receipts, coupons, exchange orders and other like documents issued to the client, are subject to each Service Provider’s terms and conditions governing the provision of products and services to be provided by that Service Provider. The Travel & Cruise Company shall not be liable for any acts, omissions or defaults whether negligent or otherwise, of any Service Providers. The Travel & Cruise Company shall also not be liable (whether in contract, tort or otherwise) for any injury, illness, death, loss, damage, expense, delay or inconvenience resulting directly or indirectly from circumstances outside The Travel & Cruise Company’s control, including acts of God, war, civil disturbance, strikes, fire, flood, acts of government or other authorities, breakdowns, accidents, disease, quarantine, medical or customs regulations, and alterations, cancellations or delays concerning itineraries, timetables or accommodation.

Risk & Liability - Every effort is made to ensure that your holiday arrangements are satisfactory and we accept liability for, but only to the extent of, any loss or damage sustained by you as a direct result of our negligence. In any event, our aggregate liability to you is limited to the amount you have paid to us for the relevant tour. Each service provider is responsible for the part of the tour it conducts. Service providers are not our agents or employees and are not under our direct control. We therefore do not warrant the performance of any service provider. We do not accept, and you release us from, all liability for any injury, loss, damage, costs or expenses, including without limitation any property damage or personal injury, that you may suffer which arises out of any act or omission of a service provider or operator who provides services in connection with your tour. Any claim that you may have in relation to a service provider should be raised directly with that service provider. If we or our service providers are affected in any way by a force majeure events or other events which are beyond our control, including but not limited to war, civil disobedience, terrorism, insurrection, accident, explosion, sickness, fire, floods, severe weather, acts of God, acts of Government, alteration or cancellation of scheduled air services, accidents to or failure of machinery or equipment or industrial action, we may in our discretion vary or cancel any itinerary or arrangement in relation to the tour as we consider necessary, without incurring any liability to you. The responsibility for any injury, loss, damage, costs or expenses arising through a fault of your own if you have caused the situation. You agree to indemnify us against all actions, proceedings, claims, demands, expenses and costs (including legal costs on a full indemnity basis and whether incurred by or awarded against us) as a result of, or arising in relation to, whether directly or indirectly, your participation in the tour or any act or omission by you in relation to the tour.

Contract - The contract between The Travel & Cruise Company and the client shall be governed by the laws of the State of Queensland. By making a booking with The Travel & Cruise Company, the Client agrees to be bound by all the terms and conditions referred to in this leaflet and in The Travel & Cruise Company booking form.
